Elsevier terms and conditions of purchase
These terms and conditions of purchase ("Purchase Terms") sets forth the terms and conditions governing the purchase of products and services from the Elsevier websites that post a link to these Purchase Terms (each, a " Merchant Website") by the Elsevier group affiliate that owns the respective Merchant Website ("Elsevier," "we," "us" or "our").
These Purchase Terms expressly incorporate by reference and include the Elsevier Website’s Terms and Conditions https://www.elsevier.com/legal/elsevier-website-terms-and-conditions any applicable product specific terms of use, the Elsevier’s Privacy Policy https://www.elsevier.com/legal/privacy-policy, and any guidelines, rules or disclaimers that may be posted and updated on specific web pages of the Merchant Website, the Products or on notices that are sent to you.
By clicking on “Proceed to Pay” or “Pay” or “Proceed” on the check-out page on the Elsevier Merchant Website and/or checking the box “I have read, understood, and accepted the Terms and Conditions of Purchase”, you agree to be bound by all the terms and conditions of these Purchase Terms.

1. Contract formation
If you wish to purchase or subscribe to any of the products or services (“Products”) offered on the Merchant Website, you must submit a completed order form (“Order Form”). You will be required to select your Products for purchase or alternatively your subscription to the Products (“Subscription”) and complete your delivery and payment details. Once these have been completed, you will have a further chance to check (and correct if necessary) these details prior to submission of your order on the check-out page.
If we accept your order, you will be sent a confirmation email giving you an order number ("Email Confirmation"). Once we have sent this Email Confirmation, you will not be able to amend or cancel your order (subject to any right to cancel as described below).
We may correct any error in any unconfirmed order, marketing literature or other document or information issued by us or placed on the Merchant Website without liability.
2. Fees
The price of Products (the “Fees”) offered on the Merchant Website shall be that quoted on the Merchant Website on the date you place your order. While we make reasonable efforts to ensure that the Fees quoted on the Merchant Website are accurate, if there has been an inadvertent error, the correct Fee will be stated in the Email Confirmation and you will have the opportunity to withdraw from the order at that stage if the correct Fee is higher than that quoted. All Fees will state explicitly on the Merchant Website if they are inclusive or exclusive of any applicable Value Added Tax or other sales tax.
All Fees are exclusive of the cost of postage, packaging and delivery, which will be separately stated on the Merchant Website and/or the Email Confirmation.
Fee changes
Subject to applicable law, Elsevier may change the Subscription Fee for the Products (for periods not yet paid), from time to time and will communicate any Fee changes to you in advance and, if applicable, how to accept those changes. Fee changes will take effect at the start of the next renewal term (“Renewal Term”) following the date of the Fee change. You accept the new Fee by continuing to use the Subscription after the Fee change takes effect. If you do not agree with a Fee change, you have the right to reject the change by unsubscribing from the Product prior to the Fee change going into effect.
You acknowledge that the amount charged to your method of payment may vary if you purchase promotional offers, change your account or the amount of sales tax varies, and you authorize Elsevier to charge your method of payment for such varying amounts.
3. Payment
Payments (including any recurring payments) shall be made in accordance with the methods of payment displayed on the payment information page of the Merchant Website and in the currency indicated in the Email Confirmation. By purchasing or subscribing to the Products, you expressly authorize Elsevier to charge you for the Products and any purchases that you make in the Products. If you are paying by credit card, debit card, or local bank payment method, then you must supply your payment details when you place your order. Your card or account will be charged upon fulfilment.
For electronic Products, this is immediate,

For Subscription Products, your methods of payment will be charged before each Renewal Term of the Subscription unless cancelled in accordance with those Terms.
Elsevier, or its third-party payment processor, may ask you to supply information for the processing of your payment, including, but not limited to, your credit card number, the expiration date of the credit card, your address and any additional information to verify your identity (the “Payment Information”). You represent and warrant that you have the legal right to use all payment method(s) represented as any such Payment Information. You authorize Elsevier to provide your Payment Information to third party Payment Providers in order that your payment for the Products or/and any in- app purchases that you might make (plus any applicable taxes and other charges) can be completed.
If you wish to change your Payment Information, you can do so by accessing your Account section in the Elsevier platform or in the appropriate section of your Application Provider. It is your responsibility to keep your Account information and Payment Information updated.
4. Delivery/performance
Delivery of physical goods
Products ordered will be delivered to the shipping address stated in your Confirmation Email, subject to any geographical restrictions stated on the Merchant Website. However, the time and method of delivery of Products or performance of services will be at our discretion, unless otherwise specified and accepted as part of the order. Time for delivery or performance shall not be of the essence. Please note that orders that have multiple Products can be fulfilled/delivered to you in separate parts. If the Products delivered to you do not include all of the items that you ordered in any particular order or include incorrect items, you must inform us in writing as soon as possible. In any event, our liability is limited to the Fee of the Products not delivered or the cost of replacing such items.
If technical problems prevent or unreasonably delay delivery of the Products, the exclusive and sole remedy is either replacement or refund of the Fees, as determined by Elsevier.
Delivery of online Products
Elsevier will make the online Products accessible from a link in the Confirmation Email and/or from the My Account page on the Merchant Website. Unless otherwise stated, the online Products will be accessible for download for a period of twelve (12) months from the date that you have received the Confirmation Email.
5. Purchasing subscriptions
The Term shall commence when Elsevier processes the Subscriber’s payment of the Fees, including any applicable taxes, and activates the Subscriber's access to the Subscribed Products. Access to the Subscription is granted for the duration of the Term as set forth on the Confirmation Email.
5.1 Free Trial Offers
You may be offered to avail a free trial. Where applicable, the free trial period shall commence when you create a user account (“Free Trial Period”). This free trial will be offered for a limited period, during which time you will have access to the Products.
Where it was specified at the order page or in the Email Confirmation that free trial transforms into paid Subscription if not terminated before the end of the Trial: If you have subscribed to a Product on a free trial basis, you will not be charged until the end of your free trial. You may cancel your Subscriptions at any time before the end of the free trial period. At the end of your free trial and if you have not unsubscribed and unless otherwise specified in the Merchant Website or Product, your Subscription to the Products will automatically be rolled over into a paid Subscription for the Initial Term as selected at the time of Subscription and you will be charged the amount indicated in the Merchant Website at the time of Subscription. To unsubscribe before the end of the free trial period please visit your account page or contact the Customer service. Where applicable, the Free Trial Period shall end at the earlier of: (a) the end of the free trial period as set out in the Products; or (b) the time at which you purchase or subscribe to the Products. For EU Customer, your right of withdrawal starts to run from the first day of the Initial Term of your paid Subscriptions.
If the free trial does not automatically transform into a paid Subscription: Once your free trial ends, if you do not purchase a Subscription, you will revert to the status of a ‘Registered but unpaid’ user. No payment is required to begin a free trial.
Elsevier has the right to limit or restrict the number of free trials or Subscriptions for any Products.
5.2 Access to Subscription Products
Access to the Subscriptions will be authenticated by the use of Individual Access Credentials defined as the username/password. Elsevier will make the Subscriptions accessible using the Individual Access Credentials from the relevant Product Platform or Application as indicated in the Confirmation Email.
5.3 Subscription Renewal, Cancellation, and Refund Policy
a) Single term Subscriptions, i.e., Subscriptions that do not auto-renew are cancelled automatically after the Initial Term ends. You can extend their access to the Subscriptions for another Term by going to the “My Subscriptions” page. Unless otherwise specified in the Confirmation Email and/or checkout flow, single term Subscriptions are not eligible for any refunds.
b) Subscriptions that auto-renew (as stated in the Confirmation Email and/or checkout flow) can be cancelled at any time before that Subscription term ends from the “My Subscriptions” page. For Subscriptions that auto-renew (as stated in the Confirmation Email and checkout flow) those Subscriptions will be automatically renewed for successive terms equivalent to the duration of the Initial Term (each a "Renewal Term"), unless either party gives notice to the other no later than the last day of the end of the then current term that it does not intend to renew. If you do not wish to renew your Subscription Account, and auto-renew is enabled you must cancel your Subscription before it renews in order to avoid billing of the next renewal period’s fees via your chosen payment method. The Initial Term and each Renewal Term are collectively the "Term. The Subscription can be still used until the end of the term of that Subscription period. Upon cancellation, such Subscriptions are not eligible for refunds.
c) Only for Calendar-Year Journal Subscriptions
The Initial Term shall commence when Elsevier processes Your payment of the Fees, including any applicable taxes, and activates the Your access to the Subscription and shall continue until 31 December of the same calendar year. If the purchase is made after October 1st, then access is granted until December 31st of the following calendar year. After this Initial Term, Calendar-Year Subscriptions will renew each year according to section 5.3(b).
5.4 Termination of Subscription Products
You may cancel your Subscription at any time. If you wish to cancel your Subscription, you may do so in the relevant “My Subscriptions” page but please note that you will not be issued with a refund for the currently active Term. Upon termination or expiration of the Subscriptions, all access to the Subscriptions shall cease for the Authorized User.
Where applicable for the relevant Subscriptions, any records of Continuing Medical Education credits can be accessed post termination or expiration.
Elsevier may also terminate or suspend any and all Subscriptions and access to your Account, without notice or liability, if you breach any of the terms and conditions of use of the Products. If any Fee is not paid in a timely manner or if Elsevier is unable to process the payment using the Payment Information provided, Elsevier reserves the right to revoke your access to your Subscription and content associated with your Account.
6. Cancellations and returns
6.1 Statutory right to Cancel (only applicable to Consumer in the European Union)
Depending on the country where we deliver the Products, you may have a consumer statutory right to cancel the purchase. If you have such right, you may cancel the purchase, within the timeframe applicable to your statutory right, after date of delivery of the Product or the date the Product was purchased by sending written notice of cancellation by email to the Site's customer service department. A model cancellation form is available below for your use, but you are not obliged to use this method of cancellation.
This right of cancellation applies to all Products offered on the Merchant Website except:
(a) digital content not on a tangible medium (e.g., eBooks) once the item has been downloaded;
(b) single issue Journals;
(c) services for which performance has completed; and
(d) print books or journals that have been unsealed from their packaging.
If you cancel the purchase on this basis, we will reimburse to you all payments received from you, and if applicable, the costs of delivery (except for the additional costs arising if you choose a type of delivery other than the least expensive type of standard delivery offered by us). We may make a deduction from the reimbursement for loss in value of any goods supplied if the loss is the result of unnecessary handling by you.

6.2 Returns
You must return the goods without undue delay and in any event no later than 14 days from the date of notification of cancellation. We will then make the reimbursement without undue delay, and no later than-
(a) 14 days after the day we receive the returned goods as supplied to you, or
(b) (if earlier) 14 days after the day you provide evidence that you have returned the goods, or
(c) If there were no (physical) goods supplied, 14 days after the day on which we are informed about your decision to cancel the purchase.
We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.
Whether these rights of cancellation apply or not, you will be responsible for and will pay the cost of returning the items to us by the same method as it was delivered. The items will be returned at your risk.
6.3 Consumer Protection
If you are a consumer, your statutory rights as a consumer are not affected by these Purchase Terms, and nothing in these Purchase Terms shall exclude or limit our liability arising by virtue of consumer protection legislation, our liability for fraud or for death or personal injury caused by our negligence, or any other liability to the extent that we cannot so exclude or limit such liability as a matter of law.
